Cancellation Protection

The tenant has the option to use cancellation protection, which allows early termination of a fixed-term lease without rental liability for the remaining contract period.

1. Scope of Cancellation Protection

Cancellation protection grants the tenant the right to terminate a fixed-term lease before its end, provided that:

  • The termination date is the same as the move-out date.
  • The tenant provides written notice of termination.

2. Rental Liability for the Termination Month

The tenant is obligated to pay the full monthly rent for the month in which the termination occurs, regardless of the move-out date.

3. Release from Remaining Rent

After the termination month, the tenant is released from all rental obligations for the remaining contract period. The landlord has no right to charge rent or other fees for the remaining lease term, provided the conditions of the cancellation protection are met.

4. Exceptions

Cancellation protection does not apply if:

  • The tenant does not move out on the termination date.
  • Termination is made without written notice or the notice is submitted too late.
  • The tenant has materially breached the terms of the lease agreement.

Damage Protection

The tenant has the option to utilize damage protection, which covers sudden and unforeseen damage to the furnished apartment or its contents during the rental period. Damage protection is not an insurance policy, but part of the lease agreement terms, intended to protect the tenant from unreasonable compensation claims in case of damage.

1. Coverage of Damage Protection

Damage protection covers:

  • Damage to furniture, appliances, and other movable property caused by the tenant’s actions or negligence.
  • Minor structural damage, such as damage to walls, floors, or doors.

2. Deductible

The tenant’s deductible is a maximum of €250 per damage incident. If the repair costs exceed this amount, the landlord is responsible for the excess.

3. Exceptions

Damage protection does not cover:

  • Damage caused intentionally.
  • Damage resulting from negligence or behavior contrary to rules (e.g., smoking indoors, damage caused by pets, etc.).
  • Damage due to normal wear and tear.

4. Reporting Damage

The tenant must report the damage to the landlord immediately,. The report must include a description of the damage and how it occurred.

5. Compensation Procedure

The landlord will assess the extent of the damage and the repair costs. If the damage falls under the scope of damage protection, the tenant will be invoiced according to the deductible amount.
